Terms of Sale

1. These terms

These terms apply to quotes issued by, and orders placed with, SimPit Technologies Ltd of Leithfield, New Zealand (“SimPit”, “we”). Placing an order or accepting a quote means you accept these terms.

2. Quotes and orders

Quotes are valid for 30 days unless stated otherwise. All systems are made or configured to order; production begins once payment (or an agreed deposit) is received. Lead times are estimates, confirmed at order, and start from receipt of payment.

3. Prices and GST

Prices are shown in the selected currency and, unless stated otherwise, exclude New Zealand GST. Orders delivered within New Zealand attract 15% GST at checkout. Export orders are zero-rated for GST.

4. Shipping, customs, title and risk

We ship worldwide from New Zealand. Import duties, taxes, and customs fees in the destination country are the buyer’s responsibility. Risk in the goods passes to you on delivery; title passes when payment is received in full. Transit damage must be reported within 48 hours of delivery (see Returns & Warranty).

5. Returns and warranty

As set out in our Returns & Warranty policy: no change-of-mind returns on made-to-order goods; manufacturer’s warranty against defects; New Zealand Consumer Guarantees Act 1993 rights preserved for NZ consumers and excluded for purchases in trade, as permitted by section 43(2) of that Act.

6. SimPit Warp software

SimPit Warp is licensed, not sold. Licences are issued per PC or USB key as purchased, are non-transferable except where the licence type allows, and are non-refundable once issued. Updates are provided per the licence terms current at purchase.

7. Liability

To the maximum extent permitted by law, our total liability in connection with an order is limited to the amount you paid for that order, and we are not liable for indirect or consequential loss. Nothing in these terms excludes rights that cannot lawfully be excluded.

8. Governing law

These terms are governed by the laws of New Zealand, and the New Zealand courts have non-exclusive jurisdiction.
